Two staff members of an Al Ain nursery, as well as the nursery’s owner, have been ordered to jointly pay AED 30,000 compensation to the father of a two-year-old child after one staff member closed a door on the child’s finger, resulting in serious injury.

According to case files, the child’s father filed a lawsuit citing the traumatic amputation of the tip of the child’s finger, resulting in severe bleeding, and the loss of three cm of skin and half of the nail.

The Al Ain Court of Appeal has upheld an earlier ruling by the Al Ain Court of First Instance. The nursery’s owner had appealed the initial verdict, claiming responsibility should lie with the two staff members only. This appeal was unsuccessful.

Nurseries in Al Ain are regulated by ADEK, which sets regulatory requirements and performs inspections on educational establishments throughout the emirate of Abu Dhabi, including nurseries. ADEK’s health and safety requirements include safety proofing measures such as finger guards on doors.
